STROUD TOWNSHIP
2008 PAVILION RENTAL POLICIES

Stroud Township welcomes the opportunity to serve you as a rental patron at the picnic pavilions at Brodhead Creek Park, Big Pines Park, and Jay Albertson Park.  The Applicant should read the following policies in their entirety for important information pertaining to pavilion use as well as Township Ordinance 2-2001 regulating the use of parks.

Reservation applications for the upcoming pavilion reservation season of May through October may be made beginning February 1st.

A. POLICIES FOR PAVILION RENTAL
           The Pavilions are available to Stroud Township residents, non-residents, non-profit organizations, and businesses for social gatherings.  Higher rental fees are applicable to non-residents and groups who do not reside within the corporate Township limits.  A limited number of non-profit organizational events open to the general public may be approved subject to conditions and the sole discretion of the Township.  See Events (K.) below.

B. PAVILION RESERVATION APPLICATIONS
         
All individuals or groups requesting to use pavilions must make application by completing a Pavilion Reservation Application form and paying both a security deposit and a reservation fee.   This is an application, not a binding contract, to reserve the Pavilion.

         The reservation request is not officially confirmed, approved, or booked until the Applicant receives the Pavilion Reservation Confirmation Letter.       

         Applicants must be at least 21 years of age, must be in attendance at the gathering, and must assume responsibility for the group’s knowledge of and adherence to all township regulations.

C. RENTAL TIMES
         
Pavilions may be requested for times beginning at sunrise and concluding by dusk.  Stroud Township reserves the right to adjust the times, and will notify the Applicant if a change is necessary prior to confirming the reservation.  Please adhere to the times listed on your authorization letter, as others may be reserving the pavilion before or after you.

D. RESERVATION FEE AND SECURITY DEPOSIT PAYMENTS
         
In order to reserve a Pavilion, a $50 Security Deposit and a separate Reservation Fee must accompany a completed Pavilion Reservation Application. The fee and the deposit may be made by personal checks, money orders, cash, or certified checks.  The Security Deposit will be returned within 10 days of the event if the pavilion and park are left in good condition, and pavilion policies are followed.  Both fees will also be returned if a Reservation Application is denied.

          Damages to the park, and costs attributed to insufficient clean-up, will be subtracted from the security deposit, and if more, the Applicant will be billed. Stroud Township reserves the right to charge a higher deposit for special rental situations.  A $25. collection fee will be assessed for any check returned by the bank and if it remains unpaid after 30 days notice, you may be prosecuted in District Court.       

Resident Individual - Rental is by an individual for a non-commercial group that does not have tax-exempt non-profit status. Examples include family picnics, birthday parties, weddings, informal play groups.  To obtain a resident fee, the Applicant’s home address must be within the corporate limits of Stroud Township.  Proof of residency includes tax and utility bills and driver’s license.  Fee is $50.

Resident Non - Profit - A non-profit organization located within the Township such as scout troops, churches, school-sanctioned groups, government agencies, or civic organizations, with a 501c3 tax exemption certificate.  If the group does not meet at an address physically located in the Township, an officer or official of the organization who is a Township resident, and, is authorized by the group to enter into contracts and willing to be responsible for the group may be the Applicant.  Fee is $50.

Resident Commercial - Rental is by an authorized person representing a business, corporation, or other profit-making enterprise that is located within the corporate boundaries of Stroud Township. Individuals affiliated with the business may not use their resident status to rent pavilions on behalf of businesses which are outside the Township limits.   Fee is $50.

Monroe County Government Agency or Non-Profit Organization – Rental is by an official county government agency or non-profit with a 501c3 having the words Monroe County” as part of the official name.   Fee is $50.

       Any individual, non-profit, other organization, or business not meeting any of the above Resident or Monroe County qualifications are considered Non-Resident.  Fee is $100.

E. REFUNDS          
           Reservation fee payments are forfeited if the event is cancelled less than 2 weeks prior to the event. Security Deposits will be returned. Cancellation notices should be made in writing. Please allow ten (10) days following the date of the event for return of security deposit. Rain dates are not available; therefore, provisions should be made for inclement weather

F. USER’S RESPONSIBILITIES
      Rental patrons are required to:

          ·  Leave the Pavilion(s) in the same condition in which it was found. Remove any tape and decorations. No staples or nails are permitted to be used on pavilion or tables. No banners or signs can be affixed to other park property without a permit from the Twp. Zoning Officer.

          ·  At the conclusion of the event, clean off tables and grills, and pick up all trash.  (Suggestion: bring disposable tablecloths for a sanitary surface and to cover any graffiti as well as to make clean up easier)

          ·  Trash bags must be tied and placed in the park trashcans.  Any trash that does not fit in the trashcans with the lids on firmly, must be removed by the Applicant to prevent wildlife from getting access to it.   Please bring extra trash bags with you.

          ·  Park all motor vehicles in designated parking areas. Motor vehicles such as mopeds, motorcycles and ATV’s are prohibited on park trails and grounds.

          ·  The Applicant is responsible for informing his/her guests of park policies and is responsible for any damage to park property by members of the group.
       
G. ALCOHOLIC BEVERAGES, ILLEGAL DRUGS AND TOBACCO PRODUCTS
       
Alcohol beverages, illegal drugs, and tobacco product usage are prohibited.

H. CHARGES FOR ADMISSION
       
Admission or cover charges for reserved pavilion events are prohibited.

J. ELECTRICITY, MUSIC, FOOD, VOLLEYBALL, RIDES, TENTS, VENDORS
     
·     The pavilions are not equipped with electricity.  Generators are not permitted.

      ·     Music and microphone usage is permitted but should be included on the Pavilion Use Application as part of the event description.  Volume of music and microphone must be kept at a level that will not interfere with other rental patrons using the park or nearby residents.

     ·     No food sales are permitted. 

     ·     Volleyball posts are permitted to be erected.  All holes must be filled in at the end of the event.       

     ·     No carnival rides such as bouncy houses or inflatable slides are permitted

     ·     Tents are not permitted without specific permission from Stroud Township
    
·     Commercial vendors of any items are not permitted.  A non-profit organization which wishes to incorporate a small fundraiser, such as a raffle, or selling of club related items, can request permission on the application for the items they wish to sell.
     ·     Horseshoe Pits are available for use at Brodhead Creek Park, but Applicants will need to bring horseshoes if they wish to play. 

K.  OPEN TO THE PUBLIC EVENTS
        
A limited number of non-profit organizational events that the Applicant wishes to be open to the public, may be held at the sole discretion of the Township.  The only park pavilions that may be available for this is Brodhead Creek Park due to parking limitations.   The Applicant must have a parking lot attendant and an off-site parking plan in writing submitted to show what will occur if the parking lot is full.  Parking is not permitted along Rte. 191.

       A Certificate of Liability Insurance with Stroud Township named as the insured for the date of the event, with an aggregate limit of not less than $1,000,000. must be submitted to the Township no later than 2 weeks before the event.

L. REVOKING OF PERMITS, REFUSAL OF FUTURE RENTAL
          
Stroud Township reserves the right to: revoke a user’s permit, demand participants to leave the park during an event, keep the deposit, and/or refuse current or future rental privileges for any or all of the following:

  1. Not adhering to any of the Township rules and regulations as found in the Pavilion Rental Policies, as well as in Stroud Township Ordinance 2-2001, regulating the use of the park and other laws of Stroud Township and the Commonwealth of PA.
  2. Checks paid for the security deposit or reservation fee have “bounced” and have incurred bad check charges from the bank upon the Township attempting to deposit.
  3. Rental patrons are not conducting an event in an orderly manner.
  4. Damage is done to the pavilion or to any park property.

      5.   The Township feels that a group’s event is detrimental to the well being of other park users or staff.

        The Stroud Township Park and Recreation Board meets the fourth Tuesday of each month, at 7 p.m. in the back meeting room of the Township Municipal Center at 1211 North Fifth Street, and occasionally in one of the parks. The public is invited to attend meetings.
